Kalibrant

Terms of use and sale

Effective [PUBLICATION DATE]. This translation is provided for convenience; the French version prevails.

The short version

  • Kalibrant helps you spot scams and react. A verdict helps you decide; it is not a guarantee.
  • Subscriptions are sold and billed by Apple. You can cancel at any time in your iPhone settings.
  • With Sérénité, an analyst usually replies within 12 hours, 7 days a week. This is a target, not a guarantee.
  • Keep your 12 words on paper: without them, we cannot recover your encrypted data.

1. Purpose

These terms govern the use of the Kalibrant app and the purchase of its plans. They are agreed between you and JONSTOMP Lionel, sole trader (entrepreneur individuel) trading as Kalibrant (“Kalibrant”, “we”). Full contact details are in the legal notice.

By creating an account, you accept these terms. They are intended for individuals, for personal use.

2. The service

  • Message checks: you submit a text, an email, a link or a QR code. Kalibrant gives a verdict (safe, suspicious or dangerous), explains why and lists the steps to take.
  • Breach monitoring: Kalibrant regularly checks whether the email addresses you have confirmed appear in known data breaches, and explains the risks. Breach data is provided by Have I Been Pwned; a breach that is not yet public or not listed cannot be reported.
  • Conversations with our experts (Sérénité plan): see section 7.
  • Journal: a selection of official alerts and articles about current scams, summarised by us. Articles remain the property of their source.

3. Your account

Sign-in is passwordless, with Apple, Google or a code sent by email. You are responsible for access to your iPhone and your email address.

When your account is created, the app gives you 12 words. They are the only way to recover your encrypted data (history, detailed breaches, conversations) on a new iPhone. We do not know them and cannot rebuild them. If you lose them along with your iPhone, that data is lost; your account, your subscription and your breach monitoring are kept.

Prices are shown including VAT for France. The price that applies is the one shown by the App Store at the time of purchase, in your country and currency. Monthly limits keep the service fast and affordable for everyone; the number of checks left is shown in the app.

5. Subscription

Subscriptions are sold and billed by Apple, using the payment method of your Apple Account. Apple's terms apply to the purchase.

  • Free trial: one week, once per plan and per Apple Account. Unless you cancel at least 24 hours before the trial ends, the paid subscription starts automatically.
  • Renewal: the subscription renews automatically for the same period (one month or one year) at the current price, unless cancelled at least 24 hours before the end of the period.
  • Cancellation: at any time, in Settings > [your name] > Subscriptions. You keep access until the end of the paid period.
  • Changing plan: from the app or your iPhone settings, under Apple's rules.
  • Founding members: if we raise our prices, existing subscribers keep their price for as long as their subscription stays active without interruption.

Deleting your Kalibrant account does not stop your subscription at Apple: remember to cancel it.

6. Withdrawal and refunds

As Apple is the seller of the subscription, the 14-day right of withdrawal and refund requests are handled by Apple, at reportaproblem.apple.com, under its terms. We cannot directly refund a purchase made on the App Store.

7. Conversations with our experts

With the Sérénité plan, you can ask questions to a Kalibrant cybersecurity analyst, in an end-to-end encrypted conversation. An analyst usually replies within 12 hours, 7 days a week. This is a target, not a guarantee.

Our analysts give advice: they never act on your behalf, never ask for a password, a code received by text or your bank details, and do not access your accounts. A conversation closes when you or the analyst decide, or after 24 hours without a message; it is then deleted.

This is not an emergency service. If you are the victim of an ongoing fraud, first contact your bank to block your card, then visit cybermalveillance.gouv.fr. In France, you can report a fraudulent text by forwarding it free of charge to 33700.

8. Limits of verdicts

A verdict helps you decide; it is not a guarantee. Scammers keep changing their methods: a message rated safe may turn out to be fraudulent, and vice versa. When in doubt, do not tap and contact the organisation directly through its official channels.

Kalibrant undertakes to use reasonable means to provide reliable verdicts and advice (obligation of means). We can only be held liable for a proven fault on our part, and for the damage directly resulting from it. Nothing in these terms limits your statutory rights, including the legal guarantee of conformity for digital content and services.

9. Fair use

You agree not to:

  • use Kalibrant in an automated way or on behalf of third parties at scale;
  • try to get around your plan's limits or the service's protections, or access other people's data;
  • watch an email address that is not yours or that you are not authorised to use;
  • send our analysts abusive, threatening or unlawful messages.

Found a security flaw? Report it to contact@kalibrant.com without exploiting it: we will be grateful.

10. Availability

We do our best to keep Kalibrant running continuously, but interruptions may occur (maintenance, a provider outage, connectivity). Features evolve: we may improve or change the service, without significantly reducing what your current plan includes.

11. Ending the contract

You can delete your account at any time from the app, in the Me tab. Deletion is immediate and erases your data (see the privacy policy).

In the event of a serious breach of these terms (for example abusive use or threats towards our analysts), we may suspend or close your account, after notifying you by email where possible and giving you the chance to explain.

12. Intellectual property

The app, its name, its mascot, its texts and its content belong to Kalibrant. We grant you a personal, non-exclusive and non-transferable right to use the app on Apple devices that you own or control, for as long as you use the service.

13. Personal data

How we use your data is described in the privacy policy.

14. App Store terms

  • These terms are concluded between you and Kalibrant only, and not with Apple. Kalibrant, not Apple, is solely responsible for the app and its content.
  • Apple has no obligation to provide maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple, which may refund the purchase price. To the extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Kalibrant, not Apple, is responsible for addressing any claims relating to the app (product liability, failure to conform to legal or regulatory requirements, consumer protection, data protection).
  • In the event of a third-party claim that the app infringes their intellectual property rights, Kalibrant, not Apple, is responsible for its investigation, defence, settlement and discharge.
  • You represent that you are not located in a country subject to a US Government embargo and are not listed on any US Government list of prohibited or restricted parties.
  • You must comply with the terms of third-party services used with the app.
  • Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

15. Changes to these terms

We may update these terms. For a significant change, we will notify you in the app at least 30 days before it takes effect. If you refuse it, you can cancel your subscription and delete your account.

16. Complaints and mediation

For any complaint, please first write to contact@kalibrant.com. We will look for a solution with you.

If no solution is found, you can refer the matter free of charge to the consumer mediator we belong to: [MEDIATOR TO COMPLETE: name, postal address, website]. You must first have sent us a written complaint, and refer the matter to the mediator within one year.

17. Governing law

These terms are governed by French law. If you live in another European Union country, you keep the protection of the mandatory rules of your country's law. In the event of a dispute, you may bring proceedings before the court of the place where you lived when the contract was concluded or when the damage occurred.
